1. Who we are and what these terms cover

relaypix is operated by [COMPANY LEGAL NAME], a [STATE] [ENTITY TYPE, e.g. limited liability company] ("relaypix", "we", "us"). These Terms of Use ("Terms") apply when you use relaypix.com, app.relaypix.com, or anything else we offer (together, the "Service").

By using the Service or placing an order, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

2. Who can use relaypix

You must be at least 18, or the age of majority where you live, to place an order. Younger people may use the Service only with a parent or guardian who agrees to these Terms. We currently ship only to addresses in the United States.

3. Your photos

You keep ownership of your photos. When you upload a photo, you give us a limited permission to store, copy, resize, crop, apply the edits you choose, and print it, and to share it with our printing and shipping partners, only as needed to show you previews, make and deliver your order, and support you afterwards. We will never post or share your photos publicly without asking you first.

By uploading a photo, you confirm that you own it or have permission to print it, and that it doesn't violate anyone else's rights or the law. We may refuse or cancel an order, and refund you, if we believe a photo infringes someone's rights or is illegal, sexually exploitative, hateful or otherwise harmful. We report child sexual abuse material to the authorities.

4. Orders and prices

Before you pay, you see your order, its price and the shipping cost. Your order is confirmed once payment goes through. Prices are in US dollars and may change, but a change never affects an order you've already paid for. If we make an obvious pricing mistake, we may cancel the affected order and refund you in full.

We check each photo's resolution against the size you choose and warn you if it may print soft. If you choose to continue after a warning, we can't offer a reprint or refund for that reason. Colors on paper can look slightly different from your screen. That isn't a defect.

5. Payment

Payments are processed by Stripe. We don't see or store your full card number. By paying, you confirm that you're authorized to use the payment method.

6. Shipping

Delivery times shown are estimates and start once your order has been printed and handed to the carrier. We're not responsible for carrier delays, but we'll help if something goes wrong. Please make sure your delivery address is correct. We can't be responsible for orders sent to an address you entered incorrectly.

7. Cancellations, reprints and refunds

Every order is made just for you, so we can't accept returns or give refunds if you change your mind once production has started. If you need to cancel, email us as soon as possible. If your order hasn't gone into production yet, we'll cancel it and refund you in full.

If your order arrives damaged, defective, or not what you ordered, email us within 30 days of delivery with your order details and a photo of the problem. We'll reprint it at no cost or refund you, whichever you prefer. If a package never arrives, contact us and we'll work it out with you.

8. Using the Service fairly

Please don't misuse the Service. That includes trying to break or overload it, accessing other people's orders, using it for fraud, uploading malware, or scraping it. We may suspend access for anyone who does.

9. Our content

The relaypix name, logo, website, frame previews and other materials we create belong to us or our licensors. You may use them only to use the Service.

10. Disclaimers

We work hard to make the Service reliable, but it's provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. This doesn't limit our promise in section 7 about damaged, defective or wrong orders.

11. Limitation of liability

To the fullest extent the law allows, relaypix won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service or an order is limited to the amount you paid for the order the claim relates to. Some states don't allow certain limits, so some of these may not apply to you.

12. Indemnity

If you upload a photo you didn't have the right to use, or otherwise break these Terms, and someone brings a claim against us because of it, you agree to cover the reasonable costs we incur as a result.

13. Disputes and governing law

If something goes wrong, please email us first. Most problems can be fixed quickly that way. These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law rules. Any dispute that we can't resolve informally will be handled in the state or federal courts located in [STATE], except that either of us may bring a claim in small-claims court where it qualifies.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we'll change the date at the top of this page. Changes don't apply to orders you've already placed. Continuing to use the Service after an update means you accept the new Terms.
